These Terms of Service ("the Terms") set out the conditions of use of Cheerly ("the App"). By using the App, you are deemed to have agreed to these Terms.

1. Application

The Terms apply to all relationships between you and the developer of the App ("we," "us," or "our") concerning your use of the App.

2. Account

• You may create an account using "Sign in with Apple" with your Apple ID or using your Google account. You may also use the App locally without creating an account.
• You are responsible for managing your own account credentials.
• Accounts may not be transferred or lent to third parties.

3. Service Description

The App provides the following services:

• Habit registration, tracking, and management
• An anime-style character affection system (levels and story unlocks)
• Reminder push notifications
• Cross-device data sync via the cloud

4. Prohibited Conduct

When using the App, you must not:

• Violate any applicable laws or public order
• Interfere with the operation of the App
• Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App
• Place an excessive load on the App's servers or networks
• Impersonate another user
• Attempt or carry out unauthorized access
• Reproduce, redistribute, or repost the App's content (character art, text, etc.) without permission

5. Intellectual Property

All intellectual property rights in the characters, illustrations, text, design, and other content related to the App belong to us or to the rightful owners. You may not use, reproduce, or modify them without our permission.

6. Disclaimer

• We do not guarantee the accuracy, completeness, or usefulness of the App's content.
• We are not liable for any damages arising from your use of the App.
• We may suspend, terminate, or change the App at any time without prior notice.
• We have no obligation to recover lost data. Please manage important data on your own.

7. Service Changes and Termination

We may change or terminate the App's services at any time without prior notice to users. We are not liable for any damages caused by such changes or termination.

8. Paid Subscription

The App is free to use, but a portion of its features are available through the following auto-renewing subscription, "Cheerly Premium":

• Subscription name: Cheerly Premium
• Benefits: Unlimited habits (lifting the free-tier cap), access to bonus story episodes, and access to exclusive costumes.
• Plans and durations:
  • Monthly plan — auto-renews every 1 month
  • Annual plan — auto-renews every 1 year
• Pricing: The price for each plan is displayed in the App Store or Google Play in the currency of your region. The latest pricing can be confirmed in the in-app subscription (Premium) screen and the purchase confirmation dialog.

Important notes about the subscription:

• Payment is charged to your App Store or Google Play account at confirmation of purchase.
• The subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period, in which case the same fee will be charged.
• The renewal fee is charged to your account within 24 hours prior to the end of the current period.
• You can manage subscriptions and turn off auto-renewal in the account settings of the store you used for purchase, either the App Store or Google Play.
• If a free trial period is offered, any unused portion of the trial is forfeited at the time of purchase.
• Refunds are handled according to the refund policy of the store you used for purchase, either the App Store or Google Play.

Subscriptions are provided through the App Store or Google Play, and the terms of the store you used for purchase also apply.

9. Changes to the Terms

We may revise these Terms as needed. The revised Terms take effect once notified in the App or by another appropriate means. By using the App after such changes, you are deemed to have agreed to the revised Terms.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of Japan. Any disputes related to the App shall be subject to the exclusive jurisdiction of the court that has jurisdiction over our location, as the court of first instance.
